Terms of Service

Welcome to TANUP. These Terms of Service ("Terms") form a binding agreement between you ("User," "you") and Lucio Sianca, LLC ("TANUP," "we," "us," "our").

By downloading or using TANUP, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the app.

1. Eligibility

To use TANUP, you represent that:

• • You are legally capable of agreeing to these Terms,
• • All information you provide is accurate,
• • You will comply with all applicable laws.

2. Medical Disclaimer (Important)

Not Medical Advice

The AI Face Scan provides algorithmic assessments (skin tone, tanning progression, SPF suggestions).

These are estimates, not medical recommendations.

Consult a Professional

Always consult a dermatologist or healthcare provider, especially if you have:

• • Skin conditions
• • Sensitivity to sunlight
• • Photosensitizing medications
• • Family history of melanoma

Your Responsibility

You use TANUP at your own risk.

Lucio Sianca, LLC is not responsible for sunburn, skin damage, or health outcomes resulting from your personal choices.

3. Description of the Service

TANUP includes features such as:

• • AI Face Scan
• • UV index monitoring
• • SPF and tanning guidance
• • Vitamin D estimation
• • Progress tracking
• • Subscriptions for premium features

We may modify or discontinue any feature at any time.

4. Biometric Data & Face Scan

4.1 Consent

By using the Face Scan feature, you consent to the processing of:

• • Facial images
• • Derived biometric identifiers
• • Skin tone and texture analysis

4.2 How Images Are Used

• • Stored securely in Supabase Storage (encrypted)
• • Used only to provide TANUP features
• • Never sold or used to train AI models
• • Deleted upon request

4.3 Your Responsibilities

You agree not to upload:

• • Images of others without consent
• • Illegal or inappropriate content

We may remove content that violates these Terms.

5. User Accounts

You agree to:

• • Provide accurate information
• • Keep your login secure
• • Not share your account
• • Notify us of unauthorized access
• • Not attempt to hack, reverse engineer, or misuse the app

You are responsible for all actions taken through your account.

6. Subscriptions & Payments (App Store)

6.1 Managed by Apple

All billing for TANUP subscriptions is handled by Apple. We do not access your payment information.

6.2 Auto-Renewal

• • Subscriptions renew automatically
• • Cancel through Apple ID settings
• • Must cancel at least 24 hours before renewal

6.3 Free Trials

If you do not cancel the free trial before it ends, you will be charged automatically.

6.4 Refunds

Refunds are handled by Apple.

If a technical issue is caused directly by TANUP, contact us at contact@tanup.app and we may assist.

7. Intellectual Property

TANUP, including all software, graphics, branding, and content, is owned by Lucio Sianca, LLC.

You may not:

• • Copy, modify, or distribute TANUP
• • Reverse engineer or decompile
• • Use automated tools to access TANUP
• • Remove copyright notices

You receive a limited, personal, non-commercial, revocable license to use the app.

8. User Content

You retain ownership of your uploaded images.

By using TANUP, you grant us a license to process and store your content only to operate the Service.

You represent that you own or have rights to the content you upload.

9. Prohibited Conduct

You may not:

• • Use TANUP for illegal purposes
• • Harass or harm others
• • Upload harmful code
• • Attempt unauthorized access
• • Interfere with the Service
• • Impersonate others

10. Termination

We may suspend or terminate your account if you:

• • Engage in fraud or misuse

You may delete your account at any time.

Upon termination, your access ends and data is deleted per the Privacy Policy.

11. Disclaimers & Limitation of Liability

TANUP is provided without warranties, express or implied.

We do not guarantee:

• • Error-free operation
• • Continuous service
• • Prevention of health risks

11.2 Limitation of Liability

12. Indemnification

You agree to indemnify and hold harmless Lucio Sianca, LLC from claims arising from:

• • Your misuse of TANUP
• • Your violation of these Terms
• • Your sun exposure or tanning decisions
• • Uploaded content
• • Illegal or harmful actions

13. Governing Law & Disputes

• • Exclusive jurisdiction: courts in Delaware
• • Before filing a claim, you agree to attempt informal resolution by contacting us

14. Changes to These Terms

We may update the Terms.

If changes are significant, we will notify you via:

Continued use means acceptance.
